The question Jon Elster addresses in this challenging book is what binds societies together and prevents them from disintegrating into chaos and war. He analyses two concepts of social order: stable, predictable patterns of behaviour, and co-operative behaviour. The book examines various aspects of collective action and bargaining from the perspective of rational-choice theory and the theory of social norms. It is a fundamental assumption of the book that social norms provide an important kind of motivation for action that is (...) irreducible to rationality. In this short article, my aim is to introduce readers to some debates about religious freedom and constitutional law in the United States. I highlight a few of the enduring questions debated by political philosophers and legal scholars. For example, does the Constitution require special religious exemptions for citizens whose religious convictions put them at odds with otherwise neutral and legitimate state pol- icy? Should the Constitution be interpreted as supporting a strict secularism or a multicultural egalitarian liberal position? What (...) are the limits to religious freedom? To illustrate how these and related questions are debated I consider some recent work on religious freedom jurisprudence in the United States. (shrink)

Environmental historians are not sufficiently aware of the extent to which mid twentieth-century thinkers turned to medical geography—originally a nineteenth-century area of study—in order to think through ideas of ecology, environment, and historical reasoning. This article outlines how the French–Croatian Mirko D. Grmek, a major thinker of his generation in the history of medicine, used those ideas in his studies of historical epidemiology. During the 1960s, Grmek attempted to provide, in the context of the Annales School’s research program under the (...) leadership of Fernand Braudel, a new theoretical framework for a world history of disease. Its development was inspired by several sources, most notably the French–American Jacques M. May, who was then pioneering an opening up of medical geography and movement towards the concept of disease ecology. The cornerstone of Grmek’s “synthetic approach” to the field was the notion of “pathocenosis”. The diverse uses of this notion in the course of time—from his early agenda focused on a longue durée history of diseases in Western Antiquity to his last, relating to the new epidemiological threat of emerging infectious diseases, specifically HIV/aids—enables us firstly, to note how concepts of ecology sat uneasily alongside those of medical geography; secondly, to assess the reach and limits of his theoretical contribution to historical epidemiology; and thirdly, to understand better the uneven fortunes of his concept of pathocenosis at the end of the twentieth and beginning of the twenty-first centuries. The prospect of human genetic enhancement requires an institutional response, and probably the creation of new institutions. The governance of genetic enhancement technologies, moreover, needs to be global in scope. In this article, I analyze the debate on the global governance of human genetic enhancement. I begin by offering a philosophical justification for the need to adopt a global framework for governance of technologies that would facilitate the improvement of non-pathological genetic traits. I then summarize the main concrete proposals that (...) have recently emerged to govern genome editing at the global level. Hyperproof is a system for learning the principles of analytical reasoning and proof construction, consisting of a text and a Macintosh software program. Unlike traditional treatments of first-order logic, Hyperproof combines graphical and sentential information, presenting a set of logical rules for integrating these different forms of information. This strategy allows students to focus on the information content of proofs, rather than the syntactic structure of sentences. Using Hyperproof the student learns to construct proofs of both consequence and nonconsequence using (...) an intuitive proof system that extends the standard set of sentential rules to incorporate information represented graphically. Hyperproof is compatible with various natural-deduction-style proof systems, including the system used in the authors' Language of First-Order Logic. (shrink)

This paper addresses the question: Who or what can have a moral status in the sense that we have direct moral duties to them? It argues for a biocentric answer which ascribes inherent moral status value to all individual living organisms. This position must be defended against an anthropocentric position. The argument from marginal cases propounded by Tom Regan and Peter Singer for this purpose is criticised as defective, and a different argument is proposed. The biocentric position developed here is (...) related to that of Albert Schweitzer and Paul F. Taylor, but rejects their assumption of equal inherent value for all living organisms. It argues instead for equal moral status value for moral persons and agents, and gradual moral status value for nonpersons, depending on their degree of similarity with moral persons. Mary Ann Warren's recent book on Moral Status is also discussed. The argument is constructed as a casuistic argument, proceeding by analogical extension from persons to non-persons. The meta-ethical question of its pragmatic validity is discussed. (shrink)

In an earlier paper (Elster, 1989 a), I discussed the relation between rationality and social norms. Although I did mention the role of the emotions in sustaining social norms, I did not focus explicitly on the relation between rationality and the emotions. That relation is the main topic of the present paper, with social norms in a subsidiary part.

The eleven essays in this volume, supplemented by an editorial introduction, centre around three overlapping problems. First, why would a society want to limit its own sovereign power by imposing constitutional constraints on democratic decision-making? Second, what are the contributions of democracy and constitutions to efficient government? Third, what are the relations among democracy, constitutionalism, and private property? This comprehensive discussion of the problems inherent in constitutional democracy will be of interest to students in a variety of social sciences. The publication of Form and Object: A Treatise on Things by Tristan Garcia, Prix de Flore-winning novelist, philosopher, essayist, and screenwriter is a genuine event in the history of philosophy. Situating this event within classical, modern, and contemporary dialectical space, Jon Cogburn evaluates Garcia's metaphysics, differential ontology, and militant anti-reductionism through a series of seemingly incompatible oppositions concerning: substance and process, analysis and dialectic, simple and whole, and discovery and creation. The problem of evil is typically presented as a problem – sometimes the problem – facing theistic realists. This article takes no stance on what effect (if any) the existence of evil has on the rationality of theistic belief. Instead, it explores the possibility of using the problem of evil to generate worries for some of those who reject theistic realism. Although this article focuses on the consequences for a particular kind of religious fictionalist, the lessons adduced are intended to (...) have more general application. (shrink)

This paper considers the correspondence theory from modal logic and obtains correspondence results for models as opposed to frames. The key ideas are to consider infinitary modal logic, to phrase correspondence results in terms of substitution instances of a given modal formula, and to identify bisimilar model-world pairs.

This essay explores the lasting theoretical value of Marcuse’s “repressive desublimation” via the psychoanalytic concepts of Žižek and Lacan. It argues that Marcuse’s theory should be adapted to include Lacanian notions of death drive and enjoyment, but also that it remains particularly suitable to structurally define consumer capitalist ideologies that incorporate both drive and immediate gratification to reinforce institutional patriarchy. Combining the theories then reveals a paradoxical demand to “enjoy responsibly,” which engenders various indirect rationalizations of Marcuse’s “performance principle.” This (...) interpretation also points to various positive ideological beliefs with critical significance that exceeds Marcuse’s focus on their “higher unification.”. Hamid Vahid criticizes Tyler Burge's account of perceptual entitlement. Vahid argues that Burge's account fails to satisfy a criterion of adequacy that any correct account of perceptual warrant must satisfy. According to Vahid, a correct account of perceptual warrant must allow for perceptual beliefs which are produced by a properly functioning perceptual system yet which lack warrant. The present article argues that Vahid's critique of Burge fails. It presents numerous examples of such beliefs that are consistent with Burge's account of (...) perceptual entitlement. (shrink)

Journals are failing in their obligation to ensure that research is fairly represented to their readers, and must act decisively to retract fraudulent publications. Recent case reports have exposed how marketing objectives usurped scientific testing and compromised the credibility of academic medicine. But scant attention has been given to the role that journals play in this process, especially when evidence of research fraud fails to elicit corrective measures. Our experience with The Journal of the American Academy of Child and Adolescent (...) Psychiatry (JAACAP) illustrates the nature of the problem. The now-infamous Study 329 of paroxetine in adolescent depression was negative for efficacy on all eight protocol-specified outcomes and positive for harm, but JAACAP published a report of this study that concluded that “paroxetine is generally well tolerated and effective for major depression in adolescents.” The journal’s editors not only failed to exercise critical judgment in accepting the paper, but when shown evidence that the paper misrepresented the science, refused either to convey this information to the medical community or to retract the article. In this essay I distinguish categories of animals by their mental capacities. I then discuss whether punishment can be appropriate for animals of each category, and if so what form punishment may appropriately take for animals of each category. The aim is to illuminate each type of punishment through comparison and contrast with the others. This both forestalls the overintellectualization of punishment which arises from viewing humans as the only paradigm case and forestalls the underintellectualization of human punishment which results (...) from making no essential reference, in an account of human punishment, to the human capacity for specifically critical reasoning. In 2007, there were 182,479 injury-related deaths in the United States — including homicides, suicides, and unintentional injuries – making injuries the leading cause of death for persons under age 45. Also in 2007, nearly 30 million Americans suffered a non-fatal injury serious enough to warrant hospital treatment. The lifetime cost of fatal and non-fatal injuries occurring in 2000 is estimated to exceed $400 billion.Efforts to prevent injuries have often focused on changes to the built environment or potentially dangerous products (...) to reduce risks. Building safety into a product or environment — especially in ways that require little or no user action to confer protection — is often more effective than trying to change consumer behavior. For example, improving the crashworthiness of cars through design changes such as air bags, fire-resistant fuel systems, or electronic stability programs, is more effective than simply trying to teach operators to become safer drivers. This textbook/software package covers first-order language in a method appropriate for first and second courses in logic. The unique on-line grading services instantly grades solutions to hundred of computer exercises. It is specially devised to be used by philosophy instructors in a way that is useful to undergraduates of philosophy, computer science, mathematics, and linguistics. This publication presents a selection of photographic work by Hilde Honerud, made in collaboration with Yoga and Sports with Refugees (YSR) in Lesbos, Greece. It is introduced by a text coauthored with Jon Honerud. In order to engage with the experiences and the vulnerable position of the refugees involved, this project used increasingly apparent formal manipulations to convey an experience beyond the documentary image and to push observers to question the objectivity of images; to move from representation to immediate experience. (...) This entailed a kind of violence to the images that could only be done after spending a long time getting to know the organization and its context. The process raised a number of ethical questions, which we attempt to address in the text accompanying these images. The selection of images published here were part of the exhibition Reality Slipped into a Symbol, at the Vestfold Art Centre, Tonsberg, Norway (9 June–10 July 2022). (shrink)

This article explores the significance of feminism in transnational activism around LGBTQ protest events, namely equality marches and associated festivals in Kraków, Poznań and Warsaw in Poland. The arguments advanced in this article are based on a multi-method qualitative research project focusing on transnational cooperation in the planning and realization of LGBTQ protest events in Poland, conducted in the years 2008–2009. The authors highlight the decisively coalitional nature of the activist networks around LGBTQ politics in some of the locations studied. (...) They argue that feminists are core actors in these ‘networked solidarities’ around the oppression and marginalization of lesbian, gay, bisexual, queer and transgender people both in local and transnational contexts. Solidarity is a concept used by many research participants to account for their political actions and to rationalize intra- and intergroup dynamics shaped by complex webs of differences. The authors draw on postcolonial feminist discussions on the limits and potentialities of politics of solidarity as a ‘politics of location’ to account for tensions which some activists reported regarding their experience of ‘coalition work’. Some of these tensions related to gender politics and gender relations, always articulated in the conjunction of wider webs of power relations. (shrink)

Veronica Mars's hometown harbors a whole range of social ills. Neptune provides a very poor environment for nurturing trusting relationships. A typical resident of Neptune may quite reasonably be reluctant ever to trust fully his or her neighbors, co‐workers, and even closest friends. Veronica Mars is a far from being a typical resident of Neptune. Veronica is atypical in ways that should make her even less trusting than others in Neptune. It seems that there are some people whom Veronica genuinely (...) trusts—at least some of the time: her father Keith, Wallace Fennel and Logan Echolls.. This chapter analyzes whether Veronica genuinely trusts anyone. It first explains what 'trust' really means. Veronica's relationship with Keith, her daddy, is the best place to look for a genuinely trusting relationship in Veronica's life. The trust between them isn't perfect. Sadly, the distrust between father and daughter goes much deeper than that. (shrink)
